Terry's Health Products in North Dakota has joined a lawsuit against the DEA that is seeking to have CBD be re-classified so that it's not considered a schedule I drug.
The store owner, Lonna Brooks, said that she had been selling cbd oil from her store for several years, until the police sent some of that oil in for testing not long ago, said it tested positive for containing cannabinol.
They then forced Brooks to stop selling the product. However, Brooks wants to see the product allowed back onto her shelves and she's fighting to see that happen. And she insists that she hasn't joined the lawsuit against the DEA for personal gain.
If the product doesn't contain the THC to produce any 'high' effect, then why are store owners forced to take it down off the shelves?
A legal challenge was previously filed on behalf of the non-profit trade group Hemp Industries Association, which Brooks has joined herself. Along with the Hemp Industries Association, at least two other companies have also allegedly filed suit to challenge the current DEA standing on CBD.
As of right now, the DEA still lumps CBD in with other schedule 1 substances, that's because they say its an extract that is using extracted resin that comes from the cannabis plant.
And those behind the legal challenge against it are hoping that the court will find that the DEA doesn't have jurisdiction over cannabinoids.
For Brooks, the trial is expected to begin next spring.
